Gordon Rees Scully Mansukhani Senior Counsel Corey Bauer co-authored an article titled “Early Identification of Trade Secrets in Federal Trade Secret Cases,” published in the Defense Research Institute (DRI)’s For the Defense in its July/August 2025 issue.
The article examines how the nature of federal trade secret litigation across the country currently leads to plaintiffs failing to identify trade secrets with particularity until the later stages of the case, leading to the unintended consequences of higher discovery costs for all parties, decreased judicial economy, and the undermining of intellectual property (IP) best practices. It advocates for courts to adopt early trade secret identification requirements, such as those recommended by the Sedona Conference Commentary or implemented in the Eastern District of Louisiana, to improve the discovery process and judicial efficiency.
