Duncan Byers practice focuses principally on litigation in a wide range of complex civil and intellectual property matters in both state and federal courts, as well as state and federal appellate courts.

Duncan has extensive experience in federal and state court litigation, administrative proceedings before the Trademark Trial and Appeal Board (TTAB) and Patent Trial and Appeal Board (PTAB), and trademark and patent prosecution at the U.S. Patent and Trademark Office. His prosecution background adds considerable depth to the knowledge and skill he brings to each matter, though his principal focus is now on litigation, appeals, and consultation.

Duncan regularly counsels clients on civil disputes, litigation strategy, and intellectual property matters involving protection, enforcement, transactions, assignments, and licensing, including conducting IP audits and drafting and negotiating technology and IP transfers. He also provides strategic counseling on intellectual property portfolio development and management. He is known for pursuing outcomes tailored to each matter while prioritizing certainty for his clients.
