Gordon & Rees Partners Present at National Creditors Bar Association Spring Conference

Gordon Rees Scully Mansukhani Chicago partner Avanti Bakane, New Jersey partner Peter Siachos, and Philadelphia partner Andrew Schwartz, presented at the National Creditors Bar Association’s (“NCBA”) Spring Conference on May 18 and May 19, 2021.   

Avanti Bakane co-presented a session on telephone communications covering the Consumer Financial Protection Bureau’s (“CFPB”) Final Debt Collection Rule, and how it treats telephone communications with consumers, including voicemail, limited content messages and call cap tracking.

Peter Siachos co-presented “Defense Bar Current Case Law Roundup.” This session featured case law updates and interpretations of the Fair Debt Collection Practices Act (“FDCPA”) – including touting multiple important wins by the firm over the past year – and how defense firms apply these authorities for a winning litigation strategy.

Andrew Schwartz co-presented on the “Meaningful Attorney Involvement ("MAI") – Progress, Problems and What's Next,” that explored recent case law and included tips for handling potential MAI issues, liability, and what may be on the horizon. 

Bakane is a Certified Information Privacy Professional (“CIPP”) and co-chair of the firm’s Cyber, Privacy & Data Security group. She works with publicly traded and smaller companies alike in areas such as complex class action, antitrust, breach of contract, and general commercial litigation with a focus upon consumer class action defense. Barred in California and Illinois, Bakane has experience in federal and state courts across the country, and is a key asset in pre-suit negotiations, litigation, and compliance.

Siachos is an experienced trial lawyer who has taken 71 trials to verdict.  He routinely defends individual and class action claims including, nationwide and state class action litigations arising under consumer protection statutes and false advertising or unfair competition statutes, including alleged violations of the Telephone Consumer Protection Act ("TCPA"), Fair Debt Collection Practices Act ("FDCPA"), and the Fair Credit Reporting Act ("FCRA"). 

Schwartz is a member of the Commercial Litigation, Professional Liability, Bankruptcy, Restructuring & Creditors' Rights, and Government Regulatory & Administrative Law practice groups. His practice is largely devoted to matters regarding professional liability, concentrating on creditors' rights defense, defamation and privacy issues, business and commercial law, and legal malpractice matters.

The NCBA 2021 Spring Conference is an annual gathering providing an opportunity to meet with creditors rights attorneys, credit grantors and vendors and offers educational sessions and networking opportunities for attendees.
