Gordon & Rees’s Jason Meyer and Jeffrey Herman Author Daily Journal Article on the Impacts of Marijuana Laws on Employment

Gordon & Rees San Diego partner Jason F. Meyer and associate Jeffrey S.  Herman wrote an article published in the July 11, 2016 issue of the Daily Journal.

In the article, "Have Employees Using Medical Marijuana?" Meyer and Herman discuss the impact of legalizing marijuana use on both employers and employees. The article outlines the challenges employers face across the country with terminating employees for marijuana use when it is legal to use marijuana in various states, yet still classified under the Federal Controlled Substances Act as an illegal Schedule I drug. The authors examine the precarious overlap of "state-sanctioned" and "federally-prohibited," and offer recommendations for employers on implementing clear and comprehensive drug testing policies to comply with state and federal laws.

Meyer focuses his practice on all areas of civil litigation. His employment and labor experience includes wage and hour disputes, wrongful termination, harassment, and racial and age discrimination cases. He has arbitrated and tried matters involving employment and discrimination claims. He also provides advice and counseling to numerous clients on the subject of employee handbooks, discrimination, wage and hour violations and wrongful termination and FEHA and FMLA issues. He is a graduate of the University of California, San Diego and the University of the Pacific, McGeorge School of Law.

Herman is a member of the Environmental & Toxic Tort practice group and is also well-versed in employment litigation. He is a graduate of the University of Michigan and California Western School of Law.
