Las Vegas Team Obtains $9 Million Settlement in Construction Litigation Case

The Las Vegas construction litigation team of Managing Partner Robert Schumacher and Senior Counsel Jon Ludwig recently obtained a $9 million settlement in favor of a Las Vegas contractor involving construction of the MGM/CityCenter project. Gordon & Rees's client was owed monies for contract balance, unapproved change orders and damages for project inefficiencies due to design and scheduling delays. The contractor recorded several mechanic's liens on the project (CityCenter had not yet been amalgamated into one parcel) pursuant to NRS 108 et seq. A complaint was filed against the owner MGM/CityCenter and general contractor Perini Building Company in Clark County District Court to foreclose on the mechanic's liens, for breach of contract and other causes of action. The lawsuit of Gordon & Rees's client was consolidated into the "In Re CityCenter Litigation" case. In less than a year Gordon & Rees was able to negotiate a favorable settlement directly with the owner thereby extricating the client from the expensive In Re CityCenter Litigation case.
