San Francisco Partner Kai Peters Speaks on the Changing Legal Environment

On Sept. 17, San Francisco partner Kai Peters participated in a panel discussion, titled “Top Cases of 2012 and 2013: The Changing Legal Environment” at the annual Food and Drug Law Institute’s Advertising and Promotion Conference in Washington D.C.  Among the topics addressed were recent cases regarding preemption, advertising and promotion, off-label promotion, and First Amendment issues in the pharmaceutical and medical device arena.

Peters was joined by Freddy Jimenez (Assistant General Counsel at Johnson & Johnson), Richard Samp (Chief Counsel at Washington Legal Foundation), and Ralph Hall (Professor at the University of Minnesota) as they examined recent legal decisions involving marketing regulation issues and enforcement for drug and medical devices. The panel was moderated by Emalee Murphy (Of Counsel at Arnall Golden Gregory LLP).

The Advertising and Promotion Conference is an annual event that brings together the regulated industries and regulators responsible for overseeing the advertising and promotion of prescription drugs, medical devices, biological products, and animal drugs. Representatives from all four of the FDA’s medical product centers provide current policy and enforcement updates and information, and offer guidance on handling complicated issues in marketing and advertising. Other topics include, FDA compliance, and policy and legal issues.

Peters is a partner in the Drug and Medical Device and Life Sciences Practice Groups. He has significant experience handling complex commercial litigation, with an emphasis on representing pharmaceutical, medical device, and other FDA-regulated companies, solar companies, and hi-tech and new media companies.  Mr. Peters acts as national and local litigation counsel for companies of all sizes in state and federal courts, including in MDL’s and in coordinated proceedings.  He has recovered significant sums in breach of contract matters as well.
