Gordon Rees Scully Mansukhani Partner Haley M. Heath and Associate Erin Elizabeth Wadley secured a summary judgment victory in the U.S. District Court for the Western District of Arkansas on behalf of the firm’s client, a commercial property owner, in a premises liability lawsuit.
The plaintiff alleged that the property owner failed to maintain the premises in a reasonably safe condition after she slipped on a patch of oil. The plaintiff asserted negligence claims based on an alleged failure to warn of the condition and failure to exercise ordinary and reasonable care in maintaining the premises.
After depositions and discovery, the GRSM team moved for summary judgment, arguing that the plaintiff could not establish a breach of duty because she presented no evidence showing how long the oil had been present before her fall. The court agreed with GRSM’s argument and granted the motion for summary judgment, dismissing the case against the firm’s client.
