Gordon & Rees Partner Jeffrey Lilly Authors Chapter in "Inside the Minds: Navigating Drug and Medical Device Legal Issues”

Gordon & Rees Austin partner Jeffrey R. Lilly contributed a chapter to the latest edition of “Inside the Minds: Navigating Drug and Medical Device Legal Issues.” Published by Thomson Reuters/Aspatore, the book provides an authoritative, insider’s perspective on developing strategies for resolving some of the key issues faced by drug and medical device attorneys.

In his chapter titled “Fraud on the Market,” Lilly discusses how attorneys representing drug and medical device companies need to maintain a vigilant eye for the assertion of the fraud on the market theory, as its application in pharmaceutical litigation cases is misplaced. The chapter provides a comprehensive examination of the reasons why the fraud on the market theory is misplaced in pharmaceutical litigation by utilizing numerous cases to provide practitioners with a reference tool for defending against these types of cases.

Lilly has more than 20 years’ experience as a litigator with a focus on broad-based product liability law and an emphasis on pharmaceutical and medical device mass torts. He represents Fortune 500 and international companies in state and federal court, including national MDLs. Lilly primarily handles and manages nationwide litigation issues. His multifaceted background includes private practice, government, and community involvement as a past president, executive committee member, and member of the board of directors for several nonprofit organizations. He was selected to the 2011-2014 editions of Who’s Who Legal’s annual list of product liability defense attorneys.

“Inside the Minds” provides readers with proven business and legal intelligence from leading C-level executives and lawyers. Authors are selected based on their experience and C-level standing within the business and legal communities. Gordon & Rees Austin associate Bradley B. Bush provided invaluable assistance in formulating the “Fraud on the Market” chapter.
