Houston Team Obtains Jury Trial Defense Verdict
On January 6th, 2012, Houston Partner
Barry G. Flynn
, assisted by Senior Counsel
Jonathan Miles
and
Mark W. Thayer
, won a unanimous jury verdict in Dallas District Court. Gordon & Rees's client was a former director of a privately-held corporation that developed real estate throughout the country. It was alleged that Gordon & Rees's client breached his fiduciary duties as a director of the corporation by usurping corporate opportunities and taking approximately 45 single purpose properties for his own account in violation of his fiduciary duties. The case was hotly contested and vigorously tried. However, the jury rejected Plaintiff's claims and determined that Gordon & Rees's client did not violate his fiduciary duties thereby resulting in a Take Nothing Judgment against the Plaintiff and in favor of Gordon & Rees's client. The amount in controversy was alleged to be in excess of $24 million dollars.
